I hope you are doing well. Regarding our annual NCRA PAC fundraiser, I regret to inform everyone that we will be unable to host a virtual PAC fundraiser this year. I have been working with Dave and staff the past coming weeks to determine ways in which we could possibly host a virtual fundraiser. However, because we are unable to accept PAC contributions online due to our financial software, are only permitted to receive PAC contributions by mail at this time, and are restricted by FEC regulations, a PAC fundraiser is not feasible at this time.
In the meantime, what NCRA can do is beef-up our advertising efforts for PAC. I recently attended an FEC webinar for Trade Association PACs and NCRA is permitted to solicit contributions, so long as we do so in forums that are restricted for NCRA members only and we include a notice of disclaimer—there are quite a few federal election laws concerning advertising/soliciting contributions, but we are not completely limited in this regard. I have spoken with staff, and we will be planning to send out several emails to members only, asking them to mail-in PAC contributions in lieu of the in-person fundraiser.
Lastly, I wanted to mention another major takeaway that I learned from the FEC webinar for Trade Association PACs, which concerns donations from state associations, including baskets and lottery tickets. For future NCRA PAC fundraisers, for any item donated by a state association, we must ascertain the exact value of that item. Then, once we know the value of that item, we must ensure that NCRA PAC raises 3 times the amount of that item. If we do not raise 3 times the amount of items donated for an NCRA PAC fundraiser, then NCRA PAC will be required to reimburse NCRA (and then NCRA, in turn, will reimburse the state associations who donated). This Federal Election regulation is called the One-Third rule and we must ensure compliance with it. For example, if ten states donate ten baskets for next year’s annual PAC fundraiser, each of which are worth $100 for a total of $1000, then NCRA PAC must raise 3 times that amount—we must raise at least $4,000. Additionally, the topic of lottery tickets was mentioned on the FEC webinar as well—they noted if lottery tickets are donated, that Trade Association PACs must ensure compliance with both federal election law and state gaming laws.
Again, my apologies that we are not able to host a virtual fundraiser—I was very much looking forward to it. This just means that we can start generating ideas for our most successful in-person fundraiser next year!

I hope you are doing well. Thank you for joining us yesterday evening for our PAC Governing Board call. I have attached the minutes from our call to this email.
In sum, for those of you who were unable to make the call, we are trying to determine whether we will be able to have a virtual fundraiser. Here are some major takeaways and updates following the call:
- We are unable to engage in charitable fundraising through platforms such as Virtual Run, Facebook Fundraisers, or GoFundMe. This is because those organizations are charitable organizations rather than political fundraising entities. Those charitable fundraising entities either let individuals donate funds without providing additional information (they only provide a credit card) or they donate a set amount of funds to a charity. As a political action committee, we have a different set of rules and requirements that we must comport to and we must ensure we are compliant with the Federal Election Commission. This means that we can only take contributions from individuals and those individuals must supply their occupation and employer when donating to NCRA PAC. We also have certain legal disclaimers that we must notify members of before they donate to NCRA PAC.
- On our call, I also mentioned that I would see whether NCRA can take contributions online. I have been doing extensive research on this topic and have been working with numerous members on staff this morning to see if this is possible. After several discussions with staff, it is seems we are currently unable to take NCRA PAC contributions online due to federal regulations and our financial software platform (CRM). This means that we will be urging NCRA members to print the PAC contribution form and mail it to NCRA with their contribution information since we are unable to take contributions in person or online.
- On our call, I also mentioned that I would be calling the Federal Election Commission (FEC) to see if they expanded or softened any existing PAC regulations due to COVID-19. In sum, it was a very short phone call, with which they gave me a resounding “No”. This means that we do not have any leeway in regards to PAC regulations.
- During our call, we thoroughly discussed the idea of hosting a drawing. After conducting research and realizing that it will likely take longer to receive PAC donations (because they are being mailed), the idea of a drawing seems increasingly less like a viable option. Also, given this new information, I don’t think it’s going to be plausible that we’ll be able to do anything elaborate. For instance, we may be able do something where the folks who donate by “x date,” are entered to win one prize and each of the individuals is given equal weight. I know it won’t be the biggest incentive, but we are working in unprecedented circumstances and are constrained by federal election law.
- Lastly, during my call with the FEC this morning, I was informed about a Trade Association PAC webinar that they are hosting on Wednesday. I am registered for this event and will be attending. They have noted that they will be discussing fundraising strategies—I’m not sure whether they will involve virtual fundraising strategies, but I’m hoping they will have informative information to share. I will let all of you know if there is anything exciting that I discover during this webinar.
In the meantime, given the legal parameters we are faced with, please let me know if you have any ideas for a virtual PAC fundraiser. This year, we are going to have to work very hard to think outside of the box.
